WHICH LETTING AGENT SHOULD I USE ?

October 12th, 2010
As the financial situation in the housing market worsens estate agents in Enfield that had previously relied on house sales are now switching to letting residential and commercial property.
The residential market has over time become more regulated, with the introduction of schemes to safeguard tenant’s deposits, energy performance certificates and assurances regarding electrical safety. In addition schemes involving guaranteeing the rent should tenants default are as important as some of the mandatory requirements.

If you are renting a property in Enfield use a reputable Enfield Estate Agent that offers rent guarantee insurance.

Landlords should look towards estate agents in Enfield who let property to set in place all the mandatory requirements as well as ensuring their agent is able to offer the rent guarantee option.

Agents should have available a progress system that shows how matters have been addressed before creating a tenancy contract for the landlord and tenant .

Most importantly agents should convince their clients that they have sufficient knowledge and experience to intercept those tenants who may be a problem. Beware the agent whose interest is soley on the commission and who will be long gone when matters deteriorate. For the right advise contact Enfield’s premiere letting agent , Whitehouse Residential.

Assured Shorthold Tenancies Threshold Increased to £100,000

September 24th, 2010
Whitehouse Residential, an Estate Agents in Enfield EN2 say the Government have  now published the Statutory Instrument which will raise the rent threshold for Assured Shorthold Tenancies from £25,000 to £100,000 a year.
The Assured Tenancies (Amendment) (England) Order 2010 will come into force on October 1st 2010 . Currently any tenancy where annual rent exceeds £25,000 fall outside legislation for Assured Shorthold Tenancies.
Therefore a tenancy that has started before October 1 which is for a rent in excess of £25,000 per annum but for less than £100,000 per annum will, on October 1st, automatically convert to an AST.
This means that landlords / agents will need to place any deposit into a tenancy deposit scheme , and issue section 21 notices in order to re-gain possesssion of their properties.
The situation could well become very muddled after 1st October should landlords or agents go to court with incorrect paperwork.

Ground 8 Possession Not Assured

April 19th, 2010
Recently a client of Whitehouse Residential Estate Agents in Enfield (http://whitehouseresidential.co.uksought possession of his property under ground 8 of the Housing Act 1988, however The County Court refused him possession as the solicitor representing the client was unable to show the method prescribed in the agreement for serving the notice had  been followed. The agreement specifically stated that any notice should be served by recorded delivery or registered post.
In this case because the notice was served by normal royal mail post the judge dismissed the case resulting in a new hearing being heard two months later. The landlord who was already substantially out of pocket at this time, as the tenant had not paid rent for many months ,was now facing another two months without rent.
Landlords and agents should beware of tenancy agreement requirements as they will find no favour with the County Court if the prescribed route isn’t followed.
