The Assured Tenancies (Amendment) (England) Order 2010 will come into force on October 1st 2010 . Currently any tenancy where annual rent exceeds £25,000 fall outside legislation for Assured Shorthold Tenancies.
Therefore a tenancy that has started before October 1 which is for a rent in excess of £25,000 per annum but for less than £100,000 per annum will, on October 1st, automatically convert to an AST.
This means that landlords / agents will need to place any deposit into a tenancy deposit scheme , and issue section 21 notices in order to re-gain possesssion of their properties.
The situation could well become very muddled after 1st October should landlords or agents go to court with incorrect paperwork.

Recently a client of Whitehouse Residential Estate Agents in Enfield (http://whitehouseresidential.co.uksought possession of his property under ground 8 of the Housing Act 1988, however The County Court refused him possession as the solicitor representing the client was unable to show the method prescribed in the agreement for serving the notice had been followed.The agreement specifically stated that any notice should be served by recorded delivery or registered post.
In this case because the notice was served by normal royal mail post the judge dismissed the case resulting in a new hearing being heard two months later. The landlord who was already substantially out of pocket at this time, as the tenant had not paid rent for many months ,was now facing another two months without rent.
Landlords and agents should beware of tenancy agreement requirements as they will find no favour with the County Court if the prescribed route isn’t followed.
